Information pursuant to Article 3 (2) EU Data Act

Below you will find the information pursuant to Article 3 (2) EU Data Act, which informs you about which type of data in which format and volume the vehicle you have purchased, rented or leased ("Vehicle") generates ("Product Data", see section 1.), where the Vehicle stores this Product Data (see section 2.) and how you can access, retrieve and – as the case may be – erase the Product Data (see section 3.).

1. Type, format, estimated volume of generated Product Data

The Vehicle generally generates the following types of Product Data, namely:

vehicle usage and vehicle operating data (e.g., driving speed, steering behaviour, braking behaviour, wheel rotation data, mileage, etc.) and vehicle data (e.g., battery charge status, engine oil level, etc.) continuously and in real-time in the format "unsigned int" whereas the volume may vary depending on the Vehicle model and configuration as well as usage behaviour and can amount to up to approximately 1 terabytes of Product Data per operating day.

Due to technical limitations, neither is all Product Data generated by the Vehicle transmitted nor is it regularly transmitted continuously and in real-time.

2. Data storage

The Vehicle is capable of storing parts of the Product Data on-device (see section 2.1) and on a remote server (see section 2.2).

2.1. Data Storage in the Vehicle

The majority of the Product Data referred to in section 1. is not stored in the Vehicle but is erased after a short period of time (often fractions of a second) or in any case after the end of the operating time (i.e., when the Vehicle is parked and no longer in operation).

However, there are various technical devices in the Vehicle that store Product Data for different purposes (e.g., for fault analysis). The duration of retention can currently vary between 30 days and no specific duration (to the extent the Vehicle stores Product Data on so-called ring buffers, i.e., devices with limited memory capacity where older data is overwritten once the memory is full). However, the Product Data is only stored to the extent necessary for the operation and use of the Vehicle or where required or permitted by law.

2.2. Storage on a remote server

The Vehicle transmits parts of the Product Data described in section 1. to a remote server, e.g., for the provision of "Connect Services" (if you book these separately), for monitoring product safety, for product improvement and development, for troubleshooting (in case your Vehicle supports this functionality) and where required or permitted by law. The duration of retention can currently vary between 30 days and 30 years. Please note that – as already indicated in section 1. – due to technical limitations, the Vehicle does neither transmit all Product Data, nor does it regularly transmit Product Data continuously and in real-time. The types and estimated volume of the Product Data transmitted and stored change regularly, in particular with regard to relevant Product Data transmitted for product improvement and development and for compliance with legal requirements.

3. Access to, retrieval and erasure of Product Data; quality of service

On the website https://data.porsche.com, you may – in accordance with the EU Data Act – download / obtain the relevant Product Data transmitted from the Vehicle. The terms of use for such access can be found here: https://data.porsche.com/en_IE/termsandconditions. This website, operated by Porsche Sales & Marketplace GmbH, provides you with all relevant Product Data hold by the entities of the Porsche group.

The Product Data is provided in line with the following quality of service:

In relation to the provision of relevant Product Data, technical and organizational measures have been implemented that take into account the current state-of-the-art technical and legal requirements. The website has an availability of 99% (calculated on a calendar year basis). In the event of a disruption in the operation of the website, processes are in place that generally enable the systems to be restored within eight hours during normal working hours in Germany. To meet legal requirements and standards, Product Data is made available only to authenticated users. Product Data is usually made available within 24 hours of your comprehensive request on the website. The website takes the WCAG 2.2 standard into account to ensure digital accessibility. The website also contains a brief description explaining how to use the website.

You can erase the on-device Product Data by resetting the Vehicle to its factory settings. For more information, please refer to the operating instructions for your Vehicle. You will find these in printed form in your Vehicle.

Please note that there may be other access, retrieval and/or erase options that are not related to the EU Data Act and depending on your use of the Vehicle, other companies/persons not affiliated with the Porsche group (e.g., garages you visit) may obtain Product Data from the Vehicle and offer their own access, retrieval and/or erase options for Product Data.

4. Miscellaneous

With the provision of this information, no contractual or quasi-contractual relationship or obligation is established.

The information provided does not constitute a description of the Vehicle, related services or other services provided (in particular the options for accessing, retrieving or erasing Product Data described in section 3.). The agreed nature of the Vehicle (i.e., the contractually agreed performance) is determined exclusively by the concluded contracts.

Due to technical changes to the Vehicle or the IT infrastructure (e.g., due to developments and improvements or due to legal requirements), the information described above may change from time to time. In case there are significant changes, an updated version of the information will be made available in a timely manner by appropriate means.
